PRIVACY AND PERSONAL DATA PROTECTION POLICY

This Privacy and Personal Data Protection Policy aims to inform you about how we collect, use, disseminate, and/or disclose the information we obtain through our Platform and other Services. Capitalized terms not defined herein shall have the meaning attributed to them in our Terms of Use.

This Privacy and Personal Data Protection Policy does not govern the use of data you provide to us by calling, writing, or otherwise communicating with us through the Services. By using the Services, you agree to comply with the provisions of this Policy.

1. WHAT DATA DO WE COLLECT?

We collect your personal and general data (terms defined below):

“Personal Data” refers to data that allows us to identify you or make you identifiable, such as your first name, last name, postal address, phone number, email address, credit or debit card number, location data, among others. By accepting this Privacy and Personal Data Protection Policy, you recognize and expressly authorize us to use and process all Personal Data you provide when using the Services, including, but not limited to, Personal Data obtained through:

  • a.) Registering as a user on our Platform.

  • b.) Logging in or updating your profile on our Platform on your own or through an external access provider (e.g., Facebook, Google, etc.). By doing so, you authorize each access provider to send us your profile registration data from their service, excluding your password.

  • c.) Participating in contests, giveaways, and special offers. If this data is shared with a third party, we will notify you at the time of collection. If you do not wish for your Personal Data to be shared, you can always decline to participate in giveaways, contests, or special offers.

  • d.) Conducting voluntary surveys, panels, and market studies, for which you have given your consent. Data provided in response to optional survey questions or market studies may be shared, though only in aggregate form, with our advertisers and partners.

  • e.) Browsing our Platform (cookies, IP address, beacons) to track content usage. More information on the use of cookies can be found in our Cookies Policy.

This Personal Data will be stored in our personal data banks, which have the necessary security measures and comply with the highest protection standards. Likewise, Personal Data will only be shared with Operators and third parties, if applicable, for the management, development, and contracting of the services provided by the Operators, in accordance with applicable legislation and in cases c) and d) mentioned above.

“General Data” refers to information that, by itself, does not allow us to identify you (e.g., demographic data or website visits). We may collect General Data through any of the methods mentioned above, as well as automatically through the use of industry-standard technologies. For example, each time you visit the Services, your IP address, browser, device type, and access time may be automatically collected.

“Sensitive Data” refers to all information you register on our Platform related to health information or physical characteristics that helps monitor your progress in physical activities or specialized travel requirements. By accepting this Policy, you expressly authorize us to process your Sensitive Data—such as collecting, recording, storing, and, if applicable, transferring it to Operators—to ensure proper follow-up of your activities or services, provided there is a contractual relationship with them.

2. DO WE USE YOUR DATA?

You acknowledge and agree that the processing of your Personal Data and Sensitive Data is carried out within the framework of the contractual relationship you have established with us. Unless otherwise stated in this Policy, we will not share your Personal Data or Sensitive Data with third parties without your consent, except when necessary for the management, development, and contracting of services with Operators. Your Personal Data or General Data will be used, among others, in the following cases:

  • a.) System Management: We may use your General Data for system management, server diagnosis, performance monitoring, and traffic analysis, as well as for gathering demographic data. Occasionally, we will share dissociated or anonymized General Data with third parties.

  • b.) Communication and Advertising: We will use your Personal Data to periodically send you, via email or SMS, advertisements, service updates, and offers. You may request to opt-out of surveys or advertising by emailing [email protected]. You will still receive emails related to the management of your contracts with Operators, such as confirmations or attendance notices.

  • c.) Service Operators: If we engage third-party services (e.g., data storage), we will transfer the necessary Personal, Sensitive, or General Data for them to provide their services. These parties are obligated to maintain confidentiality.

  • d.) Other Disclosures: We reserve the right to share your data: (1) in response to legal subpoenas or court orders; (2) to investigate or prevent illegal activities or fraud; (3) to protect the security of our infrastructure; (4) with affiliated companies under common control; and (5) in the event of a merger, acquisition, or asset sale.

  • e.) Surveys: We may send surveys via email or text message regarding our Services or those offered by Operators to ensure the improvement of our offerings.

3. HOW DO WE PROTECT YOUR DATA?

We constantly strive to provide the best Service by implementing new technologies and processes to protect your data:

  • a.) Security Measures: We adopt appropriate security measures to protect against unauthorized access, alteration, disclosure, loss, or destruction of your data. This includes internal reviews of data collection, storage practices, and physical/virtual security measures.

  • b.) Third-Party Links: We may include links to third parties who collect their own data. We are not responsible for the privacy policies or actions of these third parties.

4. CHILDREN’S PRIVACY

We are committed to protecting the data of minors. Our Services are not designed for, nor may they be used by, individuals under the age of 16.

5. CHANGES TO THIS POLICY

We reserve the right to update or modify this Policy at any time. We will notify you of any significant variations and obtain consent if required by law. We recommend reviewing this Policy periodically.

6. ACCESS, RECTIFICATION, OR CANCELLATION OF DATA

To keep your data updated, please contact us. You may exercise your rights to access, include, rectify, delete, or oppose the processing of your Personal Data by sending an email to [email protected].
